Our Employment Status Intelligence Platform (ESIP) is an innovative digital tool that supports clients to comply with off-payroll working rules, usually called IR35.

Who can use ESIP?

ESIP is designed for organisations with more than 10 off-payroll workers (OPWS). If you have fewer than 10 OPWs you can still benefit from our assessments. We’ll do them for you.

How can ESIP help you?

  • Assesses the employment status of each off-payroll worker (OPW) through an online assessment consisting of c.35 questions

  • Questions directed to employers responsible for getting assessments right

  • Each assessment is powered by a decision-making algorithm configured by our team of employment tax experts with reference to:
    • Employment status case law
    • The latest IR35 tribunal case outcomes
    • HMRC’s guidance

  • Provides a result for every completed employment status assessment — unlike the CEST tool, which leaves c.20% undetermined

  • Considers the seven key employment status indicators, including mutuality of obligation (MOO)

  • Considers the certainty factors and weightings towards both employed and self-employed status

  • Includes risk rating 'flags' for every assessment, highlighting the potential for status challenges

  • Assessments can be part-completed, saved, and recommenced at a later stage as required

  • Allows all users to share comments

  • Demonstrates reasonable care in reaching status decisions, as required by HMRC

  • Monitors engagements with new and existing OPWs going forward

  • Builds a history of each OPW and creates an audit trail of each decision for use in any disputes

  • Stores documents: e.g. contracts and other supporting evidence against OPWs' records

  • Notifies users of actions due: e.g. periodic reassessment of engaged OPWs

  • Generates employment status determination statement (SDS) to confirm decisions and enable full compliance

  • Includes contractor appeals management functionality

  • Supports the onboarding of OPWs for role-based assessments prior to notifying individuals

  • Reporting functionality enables an overall view of contractors and assessment results

How much does using ESIP cost?

The fee depends on how much you use it and the number of contracted employees you assess. The starting price point is £2,500 per annum plus individual assessment fees. You access the web-based platform through an annual software licence.
